1. Acceptance of Terms

By accessing and using the Villa Lisanna website and booking our property, you accept and agree to be bound by the terms of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Booking and Reservation

Eligibility:

You must be at least 25 years old to book Villa Lisanna
You must provide accurate and complete information during booking
You are responsible for all activities and guests under your reservation

Reservation Confirmation:

A reservation is confirmed only after payment of the required deposit (50% of rental price)
A booking confirmation email will be sent to your provided email address
Check-in time is 4:00 PM and check-out time is 11:00 AM

3. Payment Terms

Rental Deposit: 50% of nightly rate × number of nights due upon booking confirmation
Rental Balance: Remaining 50% due 30 days before check-in date
Damage/Security Deposit: $500 USD refundable security deposit collected at time of booking
- This is a REFUNDABLE SECURITY DEPOSIT held to cover potential damage to the property
- Refunded within 14 days after check-out if no damage is found
- If damage exceeds $500, guest is responsible for full repair costs
- If damage is less than $500, guest receives pro-rata refund
Occupancy/Service Fee: $100 USD non-refundable service fee (covers booking processing, cleaning coordination)
Taxes: 12% sales tax applied (varies by location: Charlotte County 5% + Florida State 7%)
Payment Method: All prices are in USD. Accepted payment methods: Visa, Mastercard, American Express
Payment Processing: Credit card transactions are processed securely through PCI-DSS compliant payment gateway
Currency: Prices are quoted and charged in USD only

4. Cancellation Policy

30+ days before arrival: Full refund of deposit and balance
15-29 days before arrival: 50% refund of deposit; balance retained
Less than 15 days before arrival: No refund; full payment retained
Damage deposit ($500) is non-refundable
We strongly recommend travel insurance

5. House Rules

No Smoking: Smoking is strictly prohibited inside the villa and covered areas
No Pets: Animals are not permitted except certified service animals
Quiet Hours: 10:00 PM to 8:00 AM daily
Guest Capacity: Maximum 10 guests; exceeding this violates terms
No Parties/Events: Without prior written consent from management
Respect Property: All damage caused by guests will be charged to the booking contact

6. Damage Liability

Guests are responsible for any damage to the property caused during their stay
The $500 damage deposit will be held for 14 days after check-out
If damage exceeds the deposit, guests will be charged the full amount
Normal wear and tear is not considered damage

7. Occupancy and Liability

The booking contact person is responsible for all guests during their stay
Villa Lisanna is not responsible for personal injury, theft, or loss of personal belongings
Guests use all amenities at their own risk
All house rules must be followed; violation may result in immediate eviction without refund

8. Check-in and Check-out

Check-in: 4:00 PM (early check-in available upon request for availability)
Check-out: 11:00 AM (late check-out available for $50/hour if available)
A property manager may conduct a final walkthrough during check-out
Keys must be returned at check-out or you will be charged $150 for replacement

9. Modification and Cancellation by Villa Lisanna

Villa Lisanna reserves the right to cancel or modify reservations in the event of unforeseen circumstances (natural disasters, property damage, etc.). In such cases, guests will receive a full refund or opportunity to reschedule.

10. Limitation of Liability

Villa Lisanna and its owners/management shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, even if advised of the possibility of such damages.

11. Dispute Resolution

Any disputes arising from this agreement shall be resolved through good-faith negotiation. If negotiation fails, disputes will be subject to arbitration or mediation as appropriate.

12. Changes to Terms

Villa Lisanna reserves the right to update these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of the website and services constitutes acceptance of modified terms.

13. Chargeback Policy

Any guest who initiates a chargeback, reversal, or payment dispute with their credit card company without first attempting to resolve the matter with Villa Lisanna shall:

Forfeit all refunds and deposits
Be liable for chargeback fees ($25-$100)
Have their reservation immediately cancelled
Be prohibited from booking Villa Lisanna in the future

We encourage guests to contact us directly to resolve any billing disputes before initiating chargebacks through their financial institution.

14. Indemnification

You agree to indemnify, defend, and hold harmless Villa Lisanna, its owners, managers, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:

Your breach of these Terms of Service
Your violation of any applicable law or regulation
Your use of the website or property
Any damage caused by you or your guests to the property
Any injury or harm caused by you or your guests during your stay

15. Governing Law and Jurisdiction

Governing Law: These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Jurisdiction: You agree that any legal proceeding, lawsuit, or claim arising out of or relating to these Terms of Service or your use of the website shall be brought exclusively in the state or federal courts located in Charlotte County, Florida. You consent to the personal jurisdiction of these courts.

16. Attorney Fees and Costs

In the event of any legal action or arbitration to enforce these Terms of Service, the prevailing party shall be entitled to recover reasonable attorney fees, court costs, and expert witness fees from the non-prevailing party.

17. Severable Rights

If any provision of these Terms of Service is found to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if such modification is not possible, the provision shall be severed and the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms of Service, together with the Privacy Policy, Cookie Policy, and Disclaimer, constitute the entire agreement between you and Villa Lisanna regarding the website and rental services, and supersede all prior agreements, understandings, and negotiations, whether written or oral.
